Private businesses that can refuse to serve the public are NOT public places. Just my opinion. And this ordinance has got to be illegal, although I know that isn't the way the courts are ruling.

Shopping malls:

For every 20,000 square feet of space, 1 square foot can be designated as a smoking area (outdoors). The smoking area can be no more than 40 square feet and must be at a reasonable distance from an entrance. (50 feet is considered reasonable)
