Kawamura was employed by the Edogawa Municipal Government in April 1995, working in a section where smoking is permitted. He later complained of respiratory problems as well as neck and shoulder pains, which he attributed to passive smoking.

A Tokyo district court ruled that an employee was a victim of passive smoke in the workplace. Levying a 50,000 yen fine the court couldn't find any that any actual harm had been done to the employee except some watering eyes and a dry throat. The employee claimed that secondhand smoke gave him neck and shoulder pains. In a related development the Japan Sumo Association announced a smoking ban in a Tokyo stadium beginning next year. These stories prompted on wag to observe:

Sounds more like he got money because they didn't act fast enough in moving him.
