If the right to breath clean air exists, I am curious to hear answers to this question.

By who's standard do we determine what clean air is?

I live in a community that is rated some of the cleanest air in the country. I know we have people in this discussion group that live in large metro areas. I hear New York, New Jersey, Boston and L.A. discussed often.

If there is a right to "breath clean air" and I must leave my community to visit, say New York, has New York City violated my "rights" by not affording me the "standard" of air that I am accustomed to?

I have heard it said that the air in one of my communities smokiest bars is cleaner then New Yorkers breath 24/7/365.

If this is true, then shouldn't I have the rights to sue NYC for not supplying me with clean air if I should go there for a visit?

If not, why not? Your air could be killing me.

Good questions, Redliner. I've looked very closely at the Constitution, and I've yet to find anything that says anyone has a "right" to "clean" air, whatever THAT is.

The antis also always talk about smokers polluting "their" air, and I've wondered just how much of the air they think they own and why they also seem to think they own the air inside someone else's privately owned property.

It is always the "pollution cesspools" like NYC
and in particular, the state of California that has 5 out of the top 10 most polluted cities in the USA, that pass the worst kind of "smoker bans".

The hypocrisy of this would be astounding if it
wasn't for the true reason. This is because it's all about "money" through taxation and not the deliberate misdirection of "health" concerns or reasons.

"Health" is just the excuse, "Money" is the deal.

Thank the MSA agreement for this "state" of affairs. This agreement has now produced a clone, "the RICO ploy" by states attorneys general of trying to extort another US$280 Billion.(Looks like they have suffered a setback and trying to settle out of court)

Money's the thing, only the fanatically deluded believe it is about "Clean Air" and "Health".

If "Health" were the true case there would definitely be AIR QUALITY STANDARDS for tobacco
smoke.

The nonsense of "no safe level" is just that, pure and complete nonsense with absolutely no legitimate, scientific basis.

You're absolutely correct--it is about the money. In fact, almost all the current "for-your-own-good" or "for the sake of the children" crusades are about the money.
