It seems, Florida, a state with a smoking ban, more specifically miami beach, wants to ban private parties in private homes. Apparently its getting to be a problem. (hehehehehe) Moral to the story, be careful what u wish for. U just might get it. Big Grin

Miami Beach Wants To Outlaw Private Parties

Residents Battle Proposed Private Party Ban

MIAMI BEACH, Fla. -- Miami Beach residents and city commissioners are going head to head over a proposed amendment that would make it illegal to have private gatherings at home.

Residents met at the Miami Beach City Hall Wednesday afternoon to discuss the deep repercussions for the residents if the amendment passes.

The proposed amendment would ban all large private gatherings and would discourage private parties for events such as the Super Bowl or MTV awards in the city of Miami Beach.

It may also limit the current status as a city that welcomes events of national prestige.

Such restrictions are unheard of in other world-class cities both in the United States and Europe, and residents said they just couldn't allow this in Miami Beach.

"So the intent of the ordinance we support," Alex Heckler, an attorney representing some homeowners', said. "However, the way it is written, it actually affects everyday homeowner and resident from having their own private events."

If passed, the amendment would make illegal any private gathering of guests in your home where together guests may bring in excess of $100 of food, wine or contribution to cleaning.

This would mean that 15 guests, each bringing a gift or bottle of wine worth more $7 each, would be considered a commercial event, in violation of the law.

"Any event were your receive over $100 in gifts, goods or services would therefore be illegal and you would be fined," Heckler said.

The party may be shut down immediately and homeowners or renters would be liable for fines that would begin at $1,000 and may exceed $15,000.

The ordinance would preclude, even on private property, such events as Christmas parties, cocktail parties, birthday parties, barbecues if gifts are exchanged or food or drink contributed wherein and the total value of all gifts exceed $100.

The law was originally intended to protect homeowners from the unscrupulous renting of homes for large parties where ticket charges, sale of alcohol, large amounts of traffic, noise, garbage and other such annoyances are causing neighbors discomfort.

"I think as far as the noise issue is concerned, that needs to be modified," concerned resident Karyn Robinson said. "At 2 a.m., I don't want my kids coming downstairs saying they can't get to sleep because of noise."

That is truly scary. I'm surprised they didn't quote a single person complaining about the invasion of privacy and government intrusion.

That is just silly!
I have 7 brothers and sisters and 8 nephews and nieces. 3 of my nephews and neices have children, all of my sisters and all but one of my brothers is married. A Christmas gathering like we had at my mum's house on Christmas day had all but one brother in law there. Add mum and dad and a couple of my aunts and uncles and other ring-ins and there were about 35 people at mum and dad's house give or take 5. Each person bought gifts for sharing out, I don't know what everyone else spent but I spent between $10AU and $25AU on each one. At the gathering were 5 smokers (outside only) no loud music and we wrapped it up about 11.30PM. This gathering hurt no one any more than a family of 5 smokers living next door for a day. I can see why they are going down this path when you see what some people call a party but their must be a better way of ensuring the neighbours get a peaceful life.

It's the parties with paid amplified bands and fireworks and paid admission that are bringing this on, nothing to do with smoking.

How can a host control what people bring with them? How would enforcement know what was gifts and what was supplied?

Im not. Property rights or any other rights dont seem to be important to these kinda people.

Yup, i sure hear that. My dad was in the military and i grew up on military bases. I found a post on a belmont california website that pretty much summed up how i look at this issue so i saved it. Its not my post, but it sums it up quite nicely. Couldnt have said it better myself:


"I remember the cold war when the USA was the only thing standing between us and the fascist dictators of the communist states. We spent decades watching the news for signs that the great ideological battle between freedom and enslavement by the state would break out into nuclear Armageddon. Thankfully it never came and the evil of planned economies and every aspect of your life being run by government officials collapsed when the Soviet Union could no longer afford its nuclear arsenal. It seemed worthwhile all the billions of dollars that we had spent on weapons rather than feeding the poor or developing our economies.

What a laugh.

In the end it turned out that our own governments were just as evil as the communists. They think they have a right to tell you how to live every detail of your life. We would have been better off surrendering to the Communists, at least they weren’t two faced like the swine running our legislatures now. Soooooo... lets see. So far it's no smoking, no trans fats, no parties, and now no home (if somebody bigger and better wants yours). These are all gifts from the left. Nice going fellas.

It would seem the government does not like the idea of citizens congregating together discussing what they are up to.

Divide and conquer

The problem is the world is on a 24/7 clock and many people must adhere to that clock as well. The rest of the people are still living in "leave it to Beaver" land and don't understand why anyone is awake after 10PM or up before 7AM.

It would seem that "for the sake of the children" they should be all rounded up and put in schools and dorms high in the mountains where they can be regimented to 8 to 10 hours of sleep, isolated from the perils of the earth until they are 30 and can properly adjust.

You were a child once, I assume before the growth in loud parties, lucky bugger you! I can only guess your kids have all grown up and moved out? I'm one of those who lives around the clock, this morning a Sunday I headed off to work at 3.45AM some days it's 7.00am some it's 12.00pm or 3.00pm. You have a right to quiet enjoyment of your home, that is a right to be free of relentless parties with attendant excess noise like some unfortunate people must endure. Don't think everyone is as fortunate as you and I who live in a quiet street with quiet neighbours. Remember there is more to a law than the written words, there is the intent of the law. It is likely the intent of this one is to provide a tool to stop unreasonable intrusion into other people's lives. Do you think police will patrol the streets looking for parties over the limit?
This law is better than the American way, shot people at loud parties when you need to get some sleep.

I live in a rural area. No laws regarding loud parties, although I might discuss the loud mule down the road with his owner! Wink
